1. Information we collect
Information you provide. When you submit a form, request a quote, or contact us by email, telephone or WhatsApp, we collect your name, company name, business email address, telephone number, the service you are interested in, and the content of your message.
Information collected automatically. Our servers record your IP address, browser and device type, the pages you view, and the page that referred you. This is collected through server logs and strictly necessary cookies. See our Cookie Notice.
Information processed on behalf of customers. When we deliver infrastructure, cybersecurity or managed services, we may process technical and system data belonging to a customer. That processing is governed by the written agreement with that customer and by our Data Processing Addendum, not by this policy.
2. How we use your information
- To respond to your inquiry and prepare quotes and proposals.
- To deliver, support and invoice the services you contract with us.
- To register products, licenses and warranties with the manufacturers we represent, when your order requires it.
- To protect our systems and yours against fraud, abuse and security incidents.
- To comply with legal, tax and accounting obligations in the United States and Mexico.
- To send occasional commercial communications about our services, which you can stop at any time by replying or writing to us.
3. We do not sell or share your personal information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under California law. We do not use your personal information for automated decision-making or profiling.
4. Who we disclose it to
- Service providers that operate our business under contract: hosting, CRM and email platforms, telephony and messaging providers, and accounting services. They may use the information only to provide services to us.
- Manufacturers and distributors when a quote, license registration or warranty requires it.
- Professional advisors such as attorneys, auditors and insurers.
- Authorities, when required by law, subpoena or a lawful government request.
We do not disclose your personal information for any other purpose without your consent.
5. How long we keep it
We retain personal information only as long as necessary for the purpose for which it was collected, and afterwards for the periods required by the tax, accounting and commercial record-keeping obligations that apply to us in the United States and Mexico. When a retention period ends, the information is deleted or anonymized.
6. Your California privacy rights
If you are a California resident, you have the right to: know what personal information we have collected and how we use it; request a copy of it; request correction of inaccurate information; request deletion; opt out of the sale or sharing of personal information; limit the use of sensitive personal information; and not be discriminated against for exercising any of these rights.
To exercise any right, write to info@defynia.us or call +1 626 517 9035. We will verify your identity by confirming information we already hold, and respond within 45 days, extendable once by another 45 days when necessary. An authorized agent may submit a request on your behalf with written proof of authorization.
7. Residents of other states
Residents of other United States jurisdictions with comprehensive privacy laws may have comparable rights of access, correction, deletion and portability. We honor those requests through the same channel.
8. Security
We maintain administrative, technical and physical safeguards appropriate to the sensitivity of the information we hold. Our practices are described on our Security page. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Children
Our services are directed to businesses. We do not knowingly collect personal information from anyone under 16 years of age.
